By enrolling in or trading via the Nexgen ProTrader Funding program (including any evaluation challenges, funded account offers, resets, upgrades, add-ons, or subscriptions), you acknowledge and affirm that you have read, understood, and accept the following disclosures in full.

LIVE TRADING ACCOUNT DISCLOSURE: Nexgen ProTrader Funding may opt to fund or not to fund a live trading account for a newly qualified trader. Suppose the trader displays that he or she can remain positive and trade consistently. In that case, Nexgen may or may not choose to mirror the traders’ trades in their account to pay traders' profits that have not yet been moved into a live trading currency-based account.
1. High Risk of Loss — No Guarantee of Profit Trading in financial instruments and participating in a proprietary trading firm / funded account program involves extremely high risk. You may lose all of your account equity, including what you have paid in fees. There is absolutely no guarantee that you will generate profits, pass any evaluation, retain any funded account, or receive any payout. You should invest only in Nexgen ProTrader Funding accounts with capital you can afford to lose, without affecting your essential living expenses.
2. Evaluation & Funded Account Rules May Add Additional Risk Layers In addition to standard market risks, participants in evaluation and funded-account programs face rules, drawdown limits, time targets, profit targets, and other constraints that may restrict trading flexibility and increase the likelihood of loss. Failure to meet those rules may result in termination of participation, loss of access, forfeiture of deposited fees, or zero payout—even if you are otherwise profitable.
3. Leverage, Margin & Volatility Amplify Risk Prop Futures Trading accounts involve leverage or margin. Leverage magnifies both gains and losses. Even a small adverse move can cause a loss greater than your margin or initial capital. Market volatility, gapping, illiquidity, wide spreads, and slippage can all cause significant losses and may even exceed your deposited amount, and may cause you to lose your account via the loss limits for each account.
4. Past Performance Does Not Guarantee Future Results Any historical performance data, testimonials, or statements of previous trader results are for informational purposes only and do not constitute a guarantee of future results. Market conditions change, rules change, your skill evolves, and the combination of all these variables means you should not rely on past performance as a reliable indicator of what you will produce.

6. Technical, Infrastructure, and Third-Party Risks You are responsible for your trading environment—including hardware, software, platform stability, internet connection, power supply, data feeds, broker execution, and risk-checking rules. Even when you follow all rules, external factors (server outages, broker freezes, corporate actions, regulatory changes, hacking, connectivity issues) may prevent you from executing trades or exiting positions, leading to losses or rule violations. 7. Program Rule Changes, Terminations, or Modifications The program’s terms—including evaluation rules, drawdown limits, payouts, eligible products, trading hours, risk parameters—may change at any time at the sole discretion of Nexgen ProTrader Funding or its capital-partner firms. Changes may be applied to new accounts. You agree to monitor and abide by the current version of all rules. Failure to do so may result in account termination without payout. You accept that such changes are part of the program's risk structure.
8. Suitability & New Trader Warning This program is not suitable for novice or untrained traders. If you lack sufficient experience in trading futures, equities, forex, risk management, and systematic trading discipline, the likelihood of loss is particularly high. You should only engage in this program once you have developed a trading edge, thoroughly tested your strategy, and have a realistic understanding of the challenge structure.
9. Liability Limitation To the fullest extent permitted by law, Nexgen ProTrader Funding, its officers, directors, employees, agents and affiliates shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including but not limited to lost profits, trading losses, business interruption or loss of data arising out of your participation in this program or your trading activity—regardless of whether such liability is based in contract, tort, strict liability or otherwise.
10. Acknowledgment & Binding Contract By proceeding with any purchase, enrollment, evaluation, funded-account activation, or trade placement, you confirm that you have read, understand, and accept this Risk & Program Disclosure. You agree that your participation in the program incorporates this disclosure and binds you to all its terms. If you disagree, do not enroll or trade.
SUMMARY Trading within the Nexgen ProTrader Funding model is ultra-high risk. You may lose your entire capital, the rules themselves may cause termination, and there are no guarantees of performance or payout. Use of this program is strictly at your own risk.
